1. Acceptance of Terms

By using SpeakMyStory (the "App"), you agree to these Terms of Service (the "Terms"). If you do not agree to these Terms, please do not use the App.

2. Service Description

The App is a language learning application designed for Japanese speakers learning English. It provides the following features:

• Translation of Japanese text to English
• Text-to-speech audio generation for English text
• Speaking practice recording and progress tracking
• Diary-based English learning
• AI-powered follow-up question generation

3. Eligibility

• The App is intended for users aged 18 and older.
• Users under 18 may use the App with parental consent and supervision.
• Users under 16 may not use the App.

4. Accounts

4.1 Account Creation

Use of the App requires creating an account via Apple Sign-In or email. You must provide accurate information.

4.2 Account Security

You are responsible for maintaining the security of your account. If you discover unauthorized use, please contact us immediately.

4.3 Account Deletion

You may delete your account at any time through the account deletion feature in the App. Account deletion will remove all associated data.

5. Subscriptions and Payments

5.1 Free and Paid Features

The App offers some features for free. Additional features are available through paid subscriptions.

5.2 Payments

• Subscription payments are processed through the Apple App Store.
• Subscriptions automatically renew unless cancelled by the user.
• Cancellation must be performed through Apple's subscription management settings.

5.3 Refunds

Refunds are subject to the Apple App Store refund policy. The App does not process refunds directly.

6. User Content

6.1 Ownership

You retain ownership of the text you create (scripts, diary entries, etc.).

6.2 License Grant

You grant the App a non-exclusive right to process your content to the extent necessary for providing the service. This includes:

• Sending text to AI translation services
• Sending text to text-to-speech services
• Storing generated audio files

6.3 Prohibited Content

You must not input the following types of content into the App:

• Illegal content
• Content that infringes on the rights of others
• Obscene or harmful content
• Malware or malicious code

7. AI-Generated Content

The App uses AI technology for translation, follow-up questions, and other content generation. Please note the following regarding AI-generated content:

• Translations and AI-generated content may not always be completely accurate.
• The App does not guarantee the accuracy of AI-generated content.
• We recommend verifying translations with a native speaker or professional before use in important documents or formal settings.

8. Prohibited Activities

You must not:

• Reverse engineer, decompile, or disassemble the App
• Circumvent the App's security features
• Access the App using automated tools (bots, scrapers, etc.)
• Gain unauthorized access to other users' accounts
• Use the App for commercial bulk translation
• Interfere with the service or place excessive load on servers

9. Intellectual Property

All intellectual property rights in the App's software, design, logos, and other content (excluding user content) belong to SpeakMyStory. These Terms grant you only a limited license for personal, non-commercial use.

10. Disclaimers

10.1 Service Availability

The App is provided "as is." To the extent permitted by law, the App is not liable for service interruptions, errors, or data loss.

10.2 Translation Accuracy

The App does not guarantee the accuracy of AI translations. Translations are provided for learning purposes and are not intended for use in official or legal documents.

10.3 Learning Outcomes

The App does not guarantee specific learning outcomes. Results vary depending on individual effort and learning methods.

11. Limitation of Liability

To the maximum extent permitted by law, SpeakMyStory's liability for damages arising from use of the App is limited to the amount you paid for the App in the preceding 12 months.

12. Service Changes and Termination

• The App may add, modify, or remove features without prior notice.
• The App reserves the right to suspend or delete accounts that violate these Terms.
• If the App discontinues its service, reasonable advance notice will be provided.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Japan. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.

14. Changes to These Terms

These Terms may be updated as needed. If significant changes are made, we will notify you through the App or by email. Continued use of the App after changes constitutes acceptance of the updated Terms.
